I am having some work done at home. The guy that’s doing it lost his young son a few months ago. I told him not to bother with my place look after your family. Well a month went by and I didn’t want to bother him so I called his supervisor. I was told he wasn’t dealing with his son’s depth and committed suicide a few weeks ago. He also said the company will not be completing any of the jobs.
Now this is really sad. The poor wife has to deal with the loss of her son and partner as well as a business that she knows nothing about.
This is my problem. Me being a nice guy helped him out and paid for almost all the job. About 20k more than what he has done to date.

So do I start legal action against the wife who is a director of the company or just move on and cop it on the chin.????

Ahh crap, that's a horrible situation. Damned if you do, damned if you don't... Doesn't the business have insurance which should cover this sort of thing?

Never cop it sweet... Dept of Fair Trading... There should be insurance to cover these type of issues. You paid money - for work they were committed to complete.and REGARDLESS of the (personal, tug on my heart strings) circumstances...DIDNT. tHE SUPERVISOR Must take responsibility - I would be demanding a REFUND. Thats life in the fast lane.

I don't want to sound completely cruel but are the father and son really dead. I don't want to sound cruel again but some people will try just about anything to avoid paying someone back.

My thoughts also Colz... Are they REALLY dead ? 1st Check- google FB, then a quick visit to BDM (Births Death n Marriages) ..A deal is a deal. Deliver.Fairs Fair. Otherwise Ille be happy to take 20 grand off you for "counsilling / Consultancy / advice"... My dog died last week.

Agreed Colz... B-U-T - You missed the magic phrase... " The supervisor said...." So if the supervisor still had his job, and the company had not folded...Obviously it was business as usual. Its a little suss dont u think...

Tough one indeed. You did the right thing by giving the poor guy the option to take some time off to spend with Fam. Unfortunate it became even more tragic. But you didn't make the deal with his family but with his employer/agency. So get the money back from them is not unethical at all in my opinion.

If you want to expres your sympathy for the tragic the family is going through you can send them flowers, knowing from personal experience that is much appreciated

tough one indeed, on the one hand you want to recover your $...and on the other you have deep sympathy for them. But in all fairness to you, you need to do what is right for you.

I duuno but you sound like my type of girl. A no nonsense sheila. I think you mentioned that you were married.... What a bummer.

I've had my good nature mercilessly abused over the the years. Always good to find out what people are really like.

It is for real, I did contact her solicitor to find out the insurance company. I get the feeling he has not got insurance and the supervisor said she has instructed her solicitor to wind up the company.

Im going to get another company to finish it and try and work out if I take legal action or not. My hart says to just get on with it and leave her alone. My bank balance says otherwise.

I think there is a lesson to be learnt here and thats if anyone gets some work done in the future to make sure they have insurance... And still thats no guarantee. Those bastards will fight you tooth and nail.
Or just pay for the work that gets done.

I'd just forget about. Whats $20,000 these days.

PB, you seem like a genuine, sucessfull bloke. 20k is 20k but i'd imagine you'd sleep better at night knowing you dont have to drag this girl and her family problems through the courts / dept fair trading for the next few years.

Bank balance will always recover. Sometimes morals dont. Look at it as if was a family member...

Well...with more info to light..and now u confirm its true...I would get on with Life too now - the poor woman - work/biz IS REALLY probably the last thing on her mind, having just lost her husb and son...Its a tough one. But I have seen n heard so many stories of ppl being scammed by handymen and renovations,Its on tv all the time.. I was very skeptical to begin with. Cant get blood out of a stone- It will come back to u some other way. :)

Why would you pay in advance of work completed?
Never never.
I would ask for the money back or for the company to send someone to finish the work, unless you can afford it, then you can decide to just let it go.

A very sad situation, and some people do pay up front,,,I have my fingers crossed that you do speak gently to his wife concerning the matter, sad but he possibly had life and or business insurance.

This is a lousy situation with no easy way out.

It sounds to me as though the "supervisor" is just trying to take the easy way out and wind up what is probably a $2 company with zero assets. Your position depends on the status of the bloke doing the work. If he is an employee of a Company then the Company definitely has a legal obligation to complete the work or refund the money. If he is an independent sub-contractor your claim is against him and/or his estate which is trickier.

I would advise you to take all your paperwork, receipts etc to a Solicitor post-haste and get proper legal advice on your position and the courses of action open to you. Despite feeling sorry for the guy's wife there is no way you should be left out of pocket on this deal.

$20k = many trips to Thailand, a brand new car, or halfway to a brand new car, *ahem* lots of good times.
It's still lots of $ for some of us.

I'd approach the wife politely and show her the proof of payment, and get the $$ or most of it back. Business is business after all, nothing personal.

And that is my concern.

I had a quote this morning to finish the job and it is 13.5K. I have instructed my solicitor to contact her solicitor to make a insurance claim. I have told them if they are not insured drop it. She has been through hell already.

I would just ask the director of the comapny for a refund of the money. This should be fine then if not go further. Go with the sof approach first to be respectful then use a bigger stick if needed.
