Its not uncommon of me to set my mobile hot spot to on when in public places with the SSID xxxx xxx xxx AU

COULD this be considered public solicitation in the sense that it is appearing on people's mobile phones without their consent or by the mere fact that they have set their phones to notify of new connections negates a public solicitation.
